Will of Abraham Cox [as written]

Fauquier County VA Will Book 3, pg 419.

In the name of God Amen. I Abraham Cox of Fauquier County in the State of Virginia being weak in body but in his right mind and desirous to leave my Fortune which God has blessed me with in as much peace as may be, and that I may have nothing of this world to incumber my thoughts on Eternity; I do make this my last will and testament Revoking all former wills by me made, and first I resign my soul to God and my body to be interd.- as for my tempral Estate I give and Dispose as follows: xxxxxxx
I desire that all my just debts should be paid, Item I give to my Daughter Mary Winn and my Daughter in law Elizabeth Cox the upper part of my land to be devided from the lower part as follows begin at large box oak corner to the said Abraham Cox and John Birdwell and to run with a straight line to an oak in the lain between me and Mr. Seven French at the lower end of the apple orchard; I give to them dureing ther life at at their Death to be equally devided among there children; I also give to my daughter Winn two Negros that is Fany and Rachel I also give my Daughter in law two Negros that is Lucey and Nancy. I give to them dureing ther natural lives and at there Deaths to be Equally devided among there children. Itam I give to my son Zachariah an Ann Cox the other part of my land to be equally Devided between them at my wife's death I also give to my son Zachariah three Negros that is Dick and Simon
and Salley Itam I give to my Daughter Ann two Negros, Hannah and Garrard and which ever should die first Zachariah or Ann the Surviving one shall come in for the others part If they should have no lawful Heire; and if Boath of them should die without lawful Heire begotten of his or her body then it shall go to my Sons Thomas and William Cox and Mary Winns children. Itam I give to my wife Elizabeth Cox three Negros that is Mary and Jiney and Rose with the stock of every kind and Plantation Utentials and House furniture and that part of my land that I leve to Zah and Ann Cox I give to my wife as long as she lives and at her death, the land and house furniture to be devided between Zachariah and Ann Cox and all the
stock of every kind and plantation utentials and the three Negros with every thing in not bin disposed of to be devided between Zach and Ann and Elizabeth Cox and Mary Winn and William Cox. Item I appoint my wife Exectrix and my son Zachariah Cox and my grand son James Cox Executors of this my last will and testament this I Declare to be my last will and testament in witness thereof I have set my hand and seal this first Day of February one thousand Eight Hundred and three

Signed sealed and acknowledged in the presence of I desire that my son William Cox should have one of the three Negros that is Rose at my wifes Death.

In the name of God Amen, I John Winn of the County of Fauquier do make this my last will and Testament, revoking all former wills and testaments, Item, I give and bequeathe unto my dear and beloved wife Mary Winn all my estate of every discription, (viz) one negro girl named Fanny and my stock of every kind, and my household and kitchen furniture for her to have and to hold, during her natural life, for the purpose of maintaining and educating my minor children.-

Item. At the decease of my wife Mary Winn, I give and bequeathe the said negro named Fanny unto my daughter Mary Cox Winn to her and her heirs forever.

Item, I give and bequeathe the residue of my estate which shall be remaining at the decease of my said wife to be equally divided among my children. John Smallwood Winn, Thomas Roby Winn, Zackry Cox Winn, John Noble Winn, Elizabeth Lombard, Sary Ann Winn, Hester Verlinda Winn, and my grand son Daniel Gillerson.

Lastly, I constitute and appoint my wife Mary Winn and my son Thomas Roby Winn to be the executors of this my last will and testament. In witness where of I have hereunto set my hand and seal this eighteenth day of August, eighteen hundred and one-

His estate was in the Monroe County Probate Court from 1831 to 1835 with no wife mentioned. In NC George Heilman was associated with the Millers.

In June 2, 1815 he was living in Cabarrus County, NC where he purchased 66 acres on Waters of Big Cold Water Creek, Cabarrus County from Jacob Hileman living in Rowan County.

In January 25, 1819, living in Cabarrus County, NC sold land on waters of Coldwater Creek in Cabarrus county to Christian Holteman of Cabarrus County, NC.

In April1819, living in Cabarrus County, NC purchased land on the waters of Little Coldwater Creek from Jacob Hileman who was living in Rowan County, NC.

June 2, 1815 living in Rowan county sold 66 acres on Waters of Big cold Water Creek, Cabarrus County to George Hileman living in Cabarrus County, NC.
July 18, 1816 appointed overseer of Salisburg Road from Murph's field to Rowan line working all hands worked by Henry Cline.
July 1816 On Superior Court Jury list.
April 1819 living in Rowan County sold land on the waters of Little Coldwater Creek to George Hileman who was living in Cabarrus County, NC

12/98 Note from GenForum (Sharon Inskip) Jacob was a native of Pennsylvania but his parents supposedly came from Germany prior to the Revolutionary War and settled in Pa. At age 23 Jacob married (1st) Eva Rumbold and produced 3 children, Jacob, John and George, then married (2nd) Christina Diehl. In 1819, Jacob Sr. emigrated from North Carolina to Union City, Illinois with all of his children except Jacob Jr. who remained in North Carolina.

Jacob Hileman, Jr. purchased 166 acres of land on the Waters of Great Cold Water Creek from Jacob Hileman, Sr.

Married at 23 years of age. Emigrated from North Carolina, arriving in Union County, Illinois on October 13, 1819 to become one of the early settlers of Union County, Illinois. All of his children, with the exception of Jacob, the oldest, moved to Illinois with him.
